Throughout the site, the terms "we", "our" and "us" refer to 1991 Southern Sky SRL, operating under the brand name Umami Lab. Umami Lab offers this website and application at www.umamilab.app (the "Service"), including all information, tools and services available, subject to your acceptance of all terms, conditions and policies stated here.

By visiting our site and/or using our Service, you agree to be bound by the following terms and conditions ("Terms of Service"). These Terms apply to all users of the Service, including free and paid subscribers.

Please read these Terms carefully before accessing or using our Service. If you do not agree to all terms, you may not access the Service.

We reserve the right to update or change these Terms at any time by publishing updates on this page. Your continued use of the Service after any modifications constitutes acceptance of those changes.

Section 1 - Service Description

Umami Lab is a web-based recipe management application that allows users to import, store, organize, translate, and share recipes. The Service includes AI-powered features (recipe import from URLs, photos, and videos) and optional paid subscription plans.

Section 2 - Account Terms

• You must be at least 16 years old to use this Service.
• You are responsible for maintaining the security of your account and password.
• You are responsible for all content posted and activity that occurs under your account.
• You must provide accurate and complete information when creating your account.

Section 3 - Subscriptions and Payments

Umami Lab offers Free, Pro (monthly or yearly), and Lifetime subscription plans, as well as credit top-ups. All prices are displayed in euros and include applicable VAT for EU customers. VAT is calculated based on your country of residence via Stripe Tax.

Payment is processed securely through Stripe. We do not store your payment card details.

Automatic renewal: Pro subscriptions renew automatically at the end of each billing period (monthly or yearly). You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period - you retain access until then.

Lifetime plan: The Lifetime plan is a one-time payment granting unlimited access to Pro features for the lifetime of the Service.

Section 4 - Right of Withdrawal and Refunds

In accordance with Article VI.53, 13° of the Belgian Code of Economic Law and Article 16(m) of the EU Consumer Rights Directive 2011/83/EU, the right of withdrawal does not apply to the supply of digital content that is not supplied on a tangible medium if performance has begun with the consumer's prior express consent and acknowledgment that the right of withdrawal is thereby lost.

By subscribing to a paid plan or purchasing credits, you expressly consent to immediate access to the digital content and acknowledge that you lose your right of withdrawal once the Service is activated or credits are delivered.

For yearly and lifetime plans, if you experience a technical issue preventing use of the Service within the first 14 days and we are unable to resolve it, we may offer a refund at our discretion. Contact us at hello@umamilab.app.

Section 5 - User Content

You retain ownership of all recipes and content you upload to the Service. By making a recipe public, you grant Umami Lab a non-exclusive, worldwide license to display that recipe on the platform and in search engine results.

You may delete your content at any time. Upon account deletion, all your personal data and private recipes will be removed. Public recipes that have been saved by other users may remain in their journals.

You are solely responsible for ensuring that you have the right to import, store, and share any recipe content you add to the Service. This includes recipes from third-party websites that may be protected by copyright or accessible only behind a paywall or subscription. Umami Lab acts solely as a hosting platform and does not verify the ownership or licensing status of imported content. In the event of a copyright complaint from a third party, the relevant content will be removed in accordance with applicable notice-and-takedown procedures, and the user who uploaded the content will be held solely responsible. 1991 Southern Sky SRL shall not be liable for any claims, damages, or legal proceedings arising from content uploaded by users.

You agree not to upload content that is illegal, infringing on third-party rights, or harmful.

Section 6 - Copyright and Notice-and-Takedown

We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, please contact us at hello@umamilab.app with: a description of the copyrighted work, the URL of the infringing content on Umami Lab, your contact information, and a statement that you have a good faith belief that the use is not authorized by the copyright owner.

Upon receipt of a valid notice, we will promptly remove or disable access to the infringing content and notify the user who posted it. Repeated infringement may result in account termination.

Section 7 - AI-Powered Features

The Service uses third-party AI models (including but not limited to Google Gemini and MiniMax) to extract and process recipe content. AI-generated outputs may contain inaccuracies. You are responsible for reviewing and verifying all imported recipes before use.

We are not liable for any errors, omissions, or inaccuracies in AI-extracted content, nor for any harm resulting from reliance on such content (including but not limited to allergenic ingredients or incorrect quantities).

Section 8 - Credits System

Certain AI-powered actions (imports, conversions, standalone translations) consume credits. Free accounts receive a limited number of credits. Additional credits can be purchased or are included with paid plans.

Credits are non-refundable and non-transferable. Unused credits from top-ups do not expire. Monthly subscription credits reset each billing cycle and do not roll over.

Section 9 - Service Availability

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience resulting from Service downtime.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. In the event of permanent discontinuation, Lifetime plan holders will be offered a pro-rata refund based on the time elapsed since purchase, calculated over a 5-year reference period.

Section 10 - Prohibited Uses

You may not use the Service to: systematically scrape or extract data, redistribute content for commercial purposes without authorization, impersonate others, upload malicious content, or attempt to access other users' accounts.

Section 11 - Limitation of Liability

To the maximum extent permitted by law, 1991 Southern Sky SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Section 12 - Governing Law

These Terms shall be governed by and construed in accordance with Belgian law. Any disputes shall be submitted to the courts of Brussels, Belgium. This does not affect your rights as a consumer under mandatory consumer protection laws of your country of residence.
